董事会 on Professional Responsibility

The 听到委员会s of the 董事会 have the authority under 规则十一 to conduct hearings on formal charges of misconduct and contested petitions for reinstatement, limited hearings on petitions for negotiated discipline, and hearings on such other matters as the Court or 董事会 may direct. Each 听到委员会 is composed of two attorney members and one public member. 听到委员会 members are appointed by the 董事会 and are eligible to serve two three-year terms.  There are 12 standing 听到委员会s and a roster of alternate 听到委员会 members, who serve when a regular member is unavailable.

The 听到委员会s consider evidence and the testimony of witnesses, 宣誓就职, in a proceeding that is public. 听到委员会s are generally guided, 但不受约束, by provisions or rules of court practice, 过程, 恳求, 和证据. In contested disciplinary proceedings, the matter is briefed at the conclusion of the hearing, and the 听到委员会 prepares a report and recommendation, with proposed findings of fact, 法律结论, 建议的制裁, 哪些已提交董事会. In contested petitions for reinstatement, the 听到委员会 files its proposed findings and recommendation directly with the Court. Petitions for negotiated discipline are considered after a limited hearing, where the 听到委员会 determines whether the agreement complies with the requirements of 规则十一 and the 董事会 规则 and if the agreed-upon sanction is justified. If the 听到委员会 approves the negotiated discipline, it files its recommendation directly with the Court. If it does not approve the negotiated discipline, the 听到委员会 issues an order rejecting the agreement of the parties.

Attorney members of the 听到委员会s (referred to as “联系 Members”) are also responsible for reviewing, 批准, or suggesting modifications to Disciplinary Counsel’s proposed dispositions of disciplinary complaints.
